This document applies when using the “Used Parts – Nupirkpigiau.lt” platform and its features.
Terms of Use
These Terms of Use govern access to and use of the “Used Parts – Nupirkpigiau.lt” platform. The platform is operated by MB “RYHA”, company registration number 306987936, registered address Gėlių g. 2A, Kretingalė, Klaipėda district, Lithuania. Contact email: info@nupirkpigiau.lt.
By using the platform, creating an account, publishing a listing or entering into a transaction, you confirm that you have read and agree to comply with these Terms.
**Translation notice.** This English text is provided for convenience. Where interpretation differs, the Lithuanian version prevails, except where mandatory law requires otherwise.
1. Purpose of the platform
The platform provides a technical environment for listing, finding, buying and selling used and other lawfully traded machinery parts, tools and equipment. Private individuals and business sellers may use the platform.
The platform is not the seller of a listed item unless MB “RYHA” is expressly identified as the seller in that listing. The sale contract is concluded directly between the seller named in the listing and the buyer.
2. Definitions
- **Platform** – the website naudotosdalys.nupirkpigiau.lt and its related features.
- **User** – any visitor or registered account holder.
- **Seller** – an individual or entity that publishes an item or accepts an order.
- **Buyer** – an individual or entity that reserves or purchases an item.
- **Business seller** – a seller acting for professional, commercial or economic purposes.
- **Private seller** – an individual selling personally owned items outside a business activity.
- **Listing** – information published on the platform about an item offered for sale.
- **Transaction** – the reservation, payment, delivery, inspection and completion process started through the platform.
3. Eligibility and accounts
An account may be created by a legally capable person aged at least 18 or by an authorised representative of a legal entity. Users must provide accurate and up-to-date information.
A person may not create multiple accounts to avoid restrictions, moderation, fees, ratings or security controls. Users are responsible for protecting their login credentials and for activity performed through their account. Suspected unauthorised access must be reported promptly and the password must be changed.
4. Seller status
At registration, a seller must correctly indicate whether they act as a private person or as a business seller. The platform may request supporting information or documents and may correct the displayed status where actual activity does not match the selected status.
When the seller is a business, consumer protection rules may apply, including statutory rights concerning distance contracts and conformity of goods. When buying from a private seller, those consumer-specific rights generally do not apply, but the platform’s buyer protection rules and general civil law remain applicable.
5. Listing requirements
A listing must be accurate, clear and not misleading. The seller must:
- use genuine photographs of the item offered;
- describe the actual condition and all known material defects;
- state the correct price, included components and quantity;
- provide a known part, OEM or manufacturer code where available;
- state compatibility only where supported by reliable information;
- avoid misleading use of third-party photographs, text or trade marks;
- pause or remove a listing when the item is no longer available.
The seller is responsible for the listing and confirms that they have the legal right to sell the item.
6. Orders and conclusion of the sale
When the buyer starts a purchase or reservation, an order is created. The transaction becomes binding when the required platform steps are completed and, where applicable, payment is confirmed.
The platform may prevent a transaction where required delivery rates, dimensions, seller verification or other mandatory information is missing. The seller may not increase the listed price after the order has been placed. The buyer must provide correct delivery and contact details.
7. Payments and platform fees
Where payment services are active, they may be provided by a separate licensed payment service provider. That provider’s terms may also apply to payment processing, identity checks, holding of funds and payouts.
Before confirming an order, the buyer is shown the item price, delivery fee, buyer protection or platform service fee and the total payable amount. The seller is shown the amount expected to be paid out and applicable fees.
Users may not intentionally move payments outside the platform to avoid fees or protection mechanisms. Payments made outside the platform are not covered by platform buyer protection.
8. Delivery
Where the platform generates a delivery label, the seller must package the item safely and hand it to the carrier within the deadline shown in the order. Unless otherwise stated, the standard handover deadline is 24 hours from preparation of the label.
The seller is responsible for proper packaging, the correct shipment contents and compliance with permitted dimensions and weight. The buyer is responsible for correct recipient information and timely collection. Carrier delays, locker capacity and other circumstances outside the platform’s control may affect estimated delivery times.
9. Buyer inspection period
After delivery, the buyer must inspect the item and report any material non-conformity within the period shown in the order. The standard inspection period is 48 hours from recorded delivery unless the order specifies otherwise.
If the buyer does not report a problem within that period, or confirms earlier that the item is satisfactory, the transaction may be completed. Detailed procedures are set out in the Buyer Protection Rules.
10. Returns and consumer rights
The buyer’s rights depend on the seller’s status and the circumstances of the transaction.
When purchasing from a business seller, mandatory consumer protection rules apply to the extent required by law. This may include the right to withdraw from a distance contract, statutory conformity remedies and other rights.
When purchasing from a private seller, the statutory 14-day distance-contract withdrawal right generally does not apply. A return may still be available under buyer protection, by agreement between the parties or under applicable civil law.
11. Communication
Transaction-related communication should take place through platform messages, the order page or the Help Centre. Spam, threats, abuse, requests for off-platform payment and unnecessary collection of personal data are prohibited.
The platform may retain communications for dispute resolution, security and enforcement of these Terms.
12. Prohibited conduct
Users may not:
- list illegal, stolen, counterfeit or dangerous items;
- manipulate reviews, views, prices or search results;
- create misleading, duplicate or fictitious listings;
- use automated tools that overload the system or collect data without permission;
- distribute malicious code or attempt to bypass security controls;
- infringe copyright, trade marks, privacy or other third-party rights;
- circumvent account restrictions or administrative decisions.
13. Moderation and restrictions
The platform may review listings and account activity using automated and manual controls. Where justified by risk, the platform may hold a listing for review, request additional information, reduce or remove visibility, limit buying, selling or messaging, suspend or close an account, or pause a transaction or payout where permitted.
Where reasonably possible, users will be informed of the reason and may challenge a decision through the Help Centre. Security methods may be withheld where disclosure would make circumvention easier.
14. Intellectual property
The platform design, software, database structure, logos and other platform materials belong to MB “RYHA” or its lawful licensors.
By uploading content, the user grants the platform a non-exclusive right to store, technically process, display and use that content for listing, search, advertising and platform operation. The user remains the owner of their content.
15. Availability
The platform aims to provide stable service but does not guarantee uninterrupted or error-free availability. Features may be temporarily limited for maintenance, security, supplier outages or force majeure.
During a pilot period, features may be changed, disabled or limited. This does not remove rights granted by mandatory law.
16. Liability
The seller is responsible for the legality, condition, description, compatibility and delivery of the item. The buyer is responsible for accurate information, selecting the correct item and using it appropriately.
The platform is responsible for administering its technical services to the extent required by law. It is not responsible for false information supplied by users, manufacturing defects, incorrect installation or damage caused by user actions, except where liability cannot legally be excluded or limited.
17. Changes to the Terms
These Terms may be updated due to changes in law, platform features, payment services or delivery partners. Material changes will be communicated through the platform or by email. Where required, users will be asked to accept the updated version.
18. Governing law and disputes
These Terms are governed by the law of the Republic of Lithuania, without limiting mandatory protections available to consumers under the law of their residence.
Users should first attempt to resolve disputes through the Help Centre. Where the seller is a business, the consumer may also use a competent alternative dispute resolution body or the courts.
